Breaking News. Good news. Texas cannot exclude Planned Parenthood from the Women’s Health Program. It’s un-freekin-constitutional.

AUSTIN, Texas (AP) — A federal judge on Monday stopped Texas from preventing Planned Parenthood from getting state funds through the Women’s Health Program.

U.S. District Judge Lee Yeakel in Austin ruled there is sufficient evidence that a law banning Planned Parenthood from the program is unconstitutional. He imposed an injunction against enforcing it until he can hear full arguments.

This surprises exactly no one, outside of the fundamentalist-evangelical-plus-Catholic right wing of the GOP. Then again, those folks are surprised when they wake up in the morning and find that the rest of us have not been transported bodily to Hell overnight for our wicked ways…

    I don’t get excited by intelligent lower Fed court decisions anymore, knowing that the case will almost certainly get to the Sup Court, who will wreak its usual havoc.

      It’s a start, Mad. Without such a lower court decision, it would be difficult for a future Supreme Court to reverse the possible decision of the current one. I agree with you to the extent that we will have to wait until Scalia wears out his third transplanted heart before that can happen…

      Maybe I’m hopelessly optimistic, but when I worked for Planned Parenthood briefly as a computer contractor in the late Eighties, the thing that struck me is how very, very many women use their services. Some who came in that door looked awfully Republican to me. This is definitely a women’s issue more than just a Democrats’ issue.

      And PP is a great whipping boy for the GOP; they need it for that reason, too.
      I suspect much of the GOP wants to see PP beaten to within an inch of its life… but not killed outright. I always remember Georgi Arbatov of the old Soviet Union (?? – there are various attributions out there, and various wordings), near the end of the Cold War, said,“We are going to do the worst thing we can do to you Americans. We are going to take away your enemy from you.” I think the GOP will stop just short of killing its enemy. And if the GOP doesn’t stop short, they may well go the way of the old Soviet Union.
