Secret Law, Awlaki Assassination, Presidential Powers And… Marty Lederman?

Glenn Greenwald discusses the interrelationship of these things, and laments that Lederman, well-known blawgger frequently critical of the Bush administration’s overreaches and later an attorney formerly in Obama’s Office of Legal Counsel (OLC), was directly involved in drafting the secret justification that allegedly allows Obama to order such extrajudicial executions as the assassination of Awlaki, who was of course an American citizen by birth. (Hi there, upyernoz; yeah, I know, his citizenship shouldn’t matter. But face it: to most Americans, it does.)

How do I hate this? Let me count the ways… Secret law. Secret processes. Absence of due process. Reckless disregard of the Fourth and Fifth Amendments (at least). Abuse of the congressional AUMF to justify something Congress surely never intended. Deteriorating relationship between the Obama executive and the whole judicial branch. Deteriorating relationship between the Obama executive and Congress.

Am I forgetting anything?
